Terms of Service

Last updated: [EFFECTIVE DATE]

These Terms of Service ("Terms") are an agreement between you and [COMPANY NAME] ("we", "us") and govern your use of OmniPost (the "Service"). By creating an account or using the Service you agree to these Terms. If you use the Service on behalf of an organisation, you confirm you are authorised to accept these Terms for it.

1. The Service

OmniPost lets you write posts, upload media and publish or schedule them to social media accounts you connect, including Facebook, Instagram, Threads, TikTok, YouTube, LinkedIn, X and Pinterest. The Service connects to those platforms only through their official APIs with your authorisation.

2. Accounts

  • You must be at least [MINIMUM AGE, e.g. 16] and provide accurate information.
  • You are responsible for keeping your password secure and for activity in your account and workspaces.
  • Workspace owners and admins control who has access to a workspace and its connected accounts.

3. Third-party platforms

When you connect a social media account you also remain bound by that platform's own terms and policies — for example the YouTube Terms of Service, Meta's terms, TikTok's Terms of Service, LinkedIn's User Agreement, X's Terms of Service and Pinterest's Terms of Service. Platforms may change or limit their APIs, apply rate limits, require review of our app, or restrict content (for example, TikTok may force posts to private until our app is audited). We are not responsible for the availability or behaviour of third-party platforms, and a post that a platform rejects or delays is not a breach of these Terms.

4. Your content

You keep all rights to the content and media you upload or publish. You grant us a limited licence to store, process and transmit that content solely to operate the Service — for example to show it to members of your workspace and to publish it to the platforms you choose. You are responsible for your content and confirm you have the rights needed to publish it.

5. Acceptable use

You agree not to use the Service to:

  • break the law or any platform's terms, community guidelines or API policies;
  • send spam, manipulate engagement, or publish to accounts you are not authorised to manage;
  • publish content that infringes others' rights, or that is unlawful, harassing, hateful or deceptive;
  • upload malware, probe or disrupt the Service, or bypass usage limits; or
  • resell or provide the Service to third parties without our agreement.

We may suspend accounts that violate these rules or put the Service or other users at risk.

6. Plans and payment

Some features require a paid plan. Prices and limits are shown in the app. Subscriptions are billed in advance through Stripe and renew automatically until cancelled; you can cancel at any time and keep access until the end of the paid period. [REFUND POLICY.] We may change prices with at least [NOTICE PERIOD, e.g. 30 days] notice.

7. Termination and deletion

You can stop using the Service and delete your account at any time from Settings. Deleting your account cancels any active subscription of workspaces you solely own and permanently deletes the data described on our Data Deletion page. We may suspend or terminate access for material breach of these Terms, with notice where reasonable.

8. Disclaimers

The Service is provided "as is" and "as available". To the extent permitted by law we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement, and we do not guarantee that every scheduled post will be published at an exact time.

9. Limitation of liability

To the extent permitted by law, [COMPANY NAME] will not be liable for indirect, incidental, special or consequential damages, or for loss of profits, data or goodwill. Our total liability for any claim relating to the Service is limited to the amount you paid us in the [12] months before the claim. [ADJUST FOR CONSUMER-PROTECTION LAW IN YOUR JURISDICTION.]

10. Privacy

Our Privacy Policy explains how we handle personal data.

11. Changes

We may update these Terms. Material changes will be announced by email or in the app at least [NOTICE PERIOD] before they take effect. Continuing to use the Service after that means you accept the new Terms.

12. Governing law

These Terms are governed by the laws of [JURISDICTION], and disputes will be resolved in the courts of [VENUE], unless mandatory law where you live says otherwise.
